My 17 year-old son, who is an Eagle Scout with 10 years’ service in the Boy Scouts of America was expelled on January 4, 2012 by a tribunal appointed by the School District Board of Education in our county for behavioral issues. Since I fully recognize that his behavior pattern does not fit the structure and values that he has been taught, I have sought help from a licensed behavioral counselor and have shared that information with the school system.
I filed an immediate appeal on my son’s behalf for various reasons, but primarily because I felt that some laws may have been broken during the tribunal proceeding. Approximately twice during the tribunal proceeding, confidential information was accidentally referenced to and disclosed on another student/defendant whose case was to be heard later that day. Although, this was entirely unintentional, we had already seen and now know the student’s name and read the disciplinary charges against her; including her grades and attendance records before realizing we were given correspondence on a student other than our son. I was the only one who noticed the mistake and interrupted the proceeding to alert those in the room of the error. Consequently, when the final judgment was rendered that my son was being expelled and sent to alternative school, I left feeling that the tribunal committee may not have been fully prepared to judge his case due to the mix up between the two cases as well as contemplating the possibility that confidential information on my own child may also have been accidentally exposed.
Unfortunately, I lost the appeal. I was notified by a generic letter stating only that the School Board has decided to uphold the original decision and nothing more. There was no mention as to the reasons why and none of my concerns were addressed or mentioned. I still have no reassurance that confidential information on students is being handled properly. The generic letter made me feel as if my son was generic and that my concerns were meaningless. For that reason, I have decided to file an appeal with the State Board of Education.
